Terms of Service

Bonsai Tracker is operated by Forgione USA, Inc., a Delaware corporation ("Forgione USA", "we", "us"). These Terms govern your use of the Bonsai Tracker website at bonsaitracker.com and the Bonsai Tracker mobile and web application at app.bonsaitracker.com (together, the "Service").

You need an account to use most features. You are responsible for the accuracy of the information you provide and for keeping your credentials secure. You must be at least 13 years old (or the minimum digital-consent age in your country) to create an account.

Bonsai Tracker offers a Free tier and paid Pro and Premium plans. Paid plans are sold and billed by Stripe (Stripe, Inc. and its affiliates), which acts as the Merchant of Record for these transactions on behalf of Forgione USA, Inc. Stripe handles payment processing, sales tax / VAT / GST calculation, collection, filing, and remittance, invoicing, refunds, and chargebacks. The name "Stripe" may appear on your bank or card statement alongside "Bonsai Tracker".

Subscriptions renew automatically at the end of each billing period unless cancelled before renewal. You can cancel at any time from your account settings or by emailing us.

We offer a 30-day refund on first-time paid subscriptions. See our Refund Policy for full details and how to request a refund.

You retain ownership of the photos, notes, logs, and other content you upload ("Your Content"). You grant Forgione USA a worldwide, non-exclusive, royalty-free licence to host, store, back up, process, and display Your Content solely to operate and improve the Service for you. You can export or delete Your Content at any time from account settings.

Optional AI guidance features may send tree metadata, photos, and prompts to third-party AI providers (currently Google and OpenAI) to generate responses. AI suggestions are informational and not professional horticultural advice.

Don't misuse the Service: no unlawful content, no harassment of other growers, no scraping, no attempts to break security or impersonate others. We may suspend or terminate accounts that violate these Terms.

Bonsai Tracker™, Nebari™, Bonsai Market™, and The Tokonoma™ are trademarks and brands of Forgione USA, Inc. All other trademarks are the property of their respective owners.

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Forgione USA's aggregate liability for any claim arising out of the Service is limited to the amount you paid us for the Service in the 12 months preceding the claim.

We may update these Terms. Material changes will be announced in-app or by email at least 14 days before they take effect.

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules.
